<p>A long standing home buyer and home seller died at age 49.  His name was Sergei and when I first met him I had the dickens of a time trying to remember how to pronounce his name.</p>
<p>He gave me a simple remedy&#8230;he said, &#8220; I am a Sir and not gay&#8221;.  And that was how I learned how to pronounce Sergei having never had a Russian client or Russian friend before.</p>
<p>Whenever we spoke or saw one another at his business, there were always plenty of smiles and laughs.   He was quite a guy and was working on getting his American citizenship this year which he was so proud of.</p>
<p>I sold Sergei&#8217;s home in Natomas back in 2001 and he and his family purchased another home from me as well as selling that one later and buying yet another house.</p>
<p>This week I will attend the memorial for Sergei at his business in Greenhaven where he was a tailor at Alterations Express.</p>
<p>Sergei was so proud that he was designated as the #1 tailor in the Sacramento area by <a title="Best of Sacramento" href="http://www.sacmag.com/media/Sacramento-Magazine/November-2004/The-Best-Of-Sacramento/">Sacramento Magazine </a>in 2004 and whenever you called his business the message recording would say, &#8220;You have reached Alterations Express, voted best of Sacramento.&#8221;</p>
<p>I will miss the conversations we had and his witty ways.  Sergei was not just a past client but became a friend as most of my clients do.  It&#8217;s hard to lose a friend.</p>
<p>Goodbye Sergei&#8230;I&#8217;ll miss you</p>

<p>The goal I set out with home buyers and home sellers is to first and foremost,  LISTEN.  It&#8217;s amazing what you can learn by simply listening.   Some home buyers wonder if their Realtor ® is hard of hearing and some sellers, too.  I&#8217;m sure you can relate&#8230;how many times do you repeat yourself or walk away shaking your head?  Is anyone listening?</p>
<p>Looking for just the right house with just the right bedrooms, big kitchen close to schools and a yard fit for a king becomes the house my boss will call home.  There is nothing quite like finding just the right home for a buyers.  To see the look in their eyes and the excitement when their offer is accepted by the seller.</p>
<p>After all the disclosures, the inspections the day finally arrives when I know that I have succeeded.  That day is when I hand the new homeowner the key to their home and say, &#8220;welcome home.&#8221;  Those are my favorite words.  Everyone succeeds.  The boss is happy and I&#8217;m happy! <img src='http://www.sacramentorealestatevoice.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' /> </p>

<p>How about absentee Real Estate Brokers?</p>
<p>Seems like there is an elephant in the room that has been and continues to be overlooked.</p>
<p>A licensed real estate agent must work under a Broker.  That means the Real Estate Broker is to oversee the agent’s work by offering assistance and training.  This is a step to help safe guard the consumer.</p>
<h3>In the State of California, there are “name only” Brokers.  What is a “name only” Broker?</h3>
<h4>This is a <a href="http://en.wikipedia.org/wiki/Real_estate_broker" target="_blank">Real Estate Broker</a> who is NOT in the same office and may be in Southern CA while the real estate agent is in Northern CA. </h4>
<p>Real Estate Brokers make a percentage of whatever the agent brings in terms of sales so there are Brokers who see dollar signs and realize they can have a lot of agents working under them and thereby make money but provide little if anything to those Realtors ® working for them.</p>
<p>It is my feeling that this is NOT in the best interest of the consumer, the home buyer and the home seller. This type of practice results in agents who have little or no supervision or training and that can only have a negative impact on the home buyers and home sellers.</p>
<h4>While these Real Estate Brokers are making money by being “in name only” so is the <a href="http://www.car.org/" target="_blank">CA Association of Realtors</a>.  Until and unless the CA Association of Realtors stands up and protects home buyers and home sellers by stopping this practice, it will continue. </h4>
<p>Real Estate Brokers have a responsibility to the public.  Banks have a responsibility to the public&#8230;correlation?</p>
<p>What do you think about this elephant in the room? Do you see a problem with Real Estate Brokers who are in name only? There was a reason behind why Brokers and agents take different exams and are given different licenses.  Do you think maybe we should expect those reasons to be adhered to?</p>

<p>And yes, I also don’t believe that a Broker can do loans and sell property.  To me, splitting your time between the two means you really aren’t excellent at either one. These are changes that I feel would work better for the consumer, the home buyer and the home seller.  Do we need to have a break down of the system before this is challenged?</p>

<p>Gena Riede of Riede Real Estate, Sacramento, CA has earned the prestigious Certified Distressed Property Expert (CDPE) designation, having completed extensive training in foreclosure avoidance and short sales. This is invaluable expertise to offer at a time when the area is ravaged by “distressed” homes in the foreclosure process.</p>
<p> Short sales allow the cash-strapped seller to repay the mortgage at the price that the home sells for, even though it is lower than what is owed on the property. With plummeting property values, this can save many people from foreclosure and even bankruptcy. More and more lenders are willing to consider short sales because they are much less costly than foreclosures.</p>
<p>In the Sacramento area, more than 1,000 homes are in danger of foreclosing. It is happening in all price ranges. Local experts say that even high-priced homes are not immune.</p>
<p>“This CDPE designation has been invaluable as I work with sellers and lenders on complicated short sales,” said REALTOR Riede. “It is so rewarding to be able to help sellers save their homes from foreclosure.” </p>
<p>Alex Charfen, founder of the Distressed Property Institute in Boca Raton, Fla., said that Realtors® such as Gena Riede with the CDPE designation have valuable training in short sales that can offer the homeowner much better alternatives to foreclosure, which virtually destroys the credit rating. These experts also may better understand market conditions and can help sellers through the emotional experience, he said.</p>
<p>The Distressed Property Institute opened in January 2008 and provides training on-site and online. The CDPE is the premier designation for Realtors helping homeowners in distress and handling short sales.</p>
<p>“Our goal is to educate as many people as possible so we can help as many homeowners as possible,” Charfen said.</p>

Sometimes, we tend to make exceptions but these exceptions could be costly. It is important to always be aware of your surroundings and to let the office staff know where and with whom you are meeting. Write it in your calendar at the office so that there is something to trace back to you.</p>
<p>I have had a couple of incidences that I will share with you so that you can avoid the same, hopefully. While holding an <strong>Open House</strong> which was <span style="text-decoration: underline">vacant,</span> I received several phones calls from a male who was very concerned about where my car was. Since I was parked down the street leaving room for potential home buyers, I told him not to worry about my car. In a very dark, deep voice in a later phone call he said that he was watching me. Needless to say I was quite frightened, packed up and left.</p>
<p>Now, the correct way to hold an <strong>Open House</strong> is to have a lender present or another <span style="text-decoration: underline">co-worker</span> with you as there is<img src="http://activerain.com/image_store/uploads/6/1/7/4/4/ar116226472544716.jpg" alt="Open House" hspace="12" width="75" height="63" align="right" /> safety in numbers. You often hear about Realtors who are beat-up, raped or killed and typically it is at an<strong> Open House</strong>. <span style="text-decoration: underline">Vacant </span>houses put you more at risk. I highly recommend that you <strong><span style="text-decoration: underline">never </span></strong>park your vehicle in a vacant house garage. If something should happen you want the neighbors to notice your car and call for help.</p>
<p>A funny episode happened quite some time back where I was showing property to some Spanish buyers, one of whom did not speak English. After having shown a few homes, the Spanish speaking home buyer got to the point where he would check to see where the lockbox was located at each house to help me out and wave me over.  At this <img src="http://activerain.com/image_store/uploads/4/8/9/7/3/ar116226485637984.jpg" alt="Man in Tub" hspace="12" width="99" height="98" align="left" />one house, he motioned me over and kept pointing to the backyard. I didn&#8217;t pay attention <img src="http://activerain.com/image_store/uploads/3/1/1/6/4/ar116226515746113.jpg" alt="Homeless Cart" hspace="12" width="82" height="62" align="right" />and tried to tell him that we would go in the front door. As I was unlocking the door, I saw a woman through the sliding glass door at the rear of the house sitting on the back stoop with a shopping cart. As we entered the house, we heard splish, splash&#8230;it was a<strong> vacant house</strong>.  I asked if anyone was there and a man&#8217;s voice said, <span style="text-decoration: underline">&#8220;Yes, I&#8217;m taking a bath.&#8221;</span> Needless to say, we left. It was a little frightening but now, funny. Certainly could have been a whole lot different for all of us. </p>
<p>As a side note, I called the police to let them know that these folks had broken into a vacant home and was told that only the seller could report this. <em>Our laws sometimes are fascinating</em>.</p>
<p><img src="http://activerain.com/image_store/uploads/9/3/1/0/7/ar11622653570139.jpg" alt="Safe" hspace="12" width="113" height="58" align="left" />With all the houses on the market, and vacant ones as well, I hope that each and everyone will stay <strong>safe</strong>. Try to always remember to <span style="text-decoration: underline">write down</span> where you are meeting your clients and just take those extra steps that many of us sometimes forget to do. It&#8217;s a good idea to pick up <span style="text-decoration: underline">pepper spray</span> at you local <strong>Real Estate store</strong> and carry it with you.</p>
<p>If you meet your home buyers at the <strong>office</strong>, they&#8217;ve been prequalified through your <strong>Lender</strong> than chances are, you&#8217;ll be fine. But, as we all know, clients don&#8217;t always come to us in such neat little packages. And since, our market has reduced our quanitity of homebuyers, lately&#8230;sometimes Realtors, don&#8217;t stop to think of their <strong>safety</strong>. Stay safe, we want to see you here for a long time!</p>

<p>Glad you asked and your question is very revel ant today since I have been helping new home buyers, first time home buyers and seasoned home buyers purchase homes and lofts in new subdivisions this past month.</p>
<p>It is important that the home buyer contact a Realtor before going to a new home builder subdivision. Otherwise, the builder does not recognize that you have any representation. Frankly, they prefer it that way. But, savvy home buyers know that it is important to be represented and have a Realtor negotiate the best deal for you.</p>
<p>Recently, I took a Bay Area couple from San Jose to a new home builder and was able to negotiate the price of the home much lower than what the builder was asking and negotiated all of the furniture and decorating items for a tremendous savings. In fact, while we were signing the papers for this transaction the builder’s negotiator called back to say that they should have asked for more money for the furniture. These home buyers got a heck of a deal and are now happily moved into their new home in Elk Grove, CA.</p>
<p>Another home buyer from Chicago who has been transferred to the Sacramento area wanted to buy a loft. We l visited several new lofts for sale in Downtown Sacramento and settled on a new loft in West Sacramento just over the Tower Bridge.  Through the negotiations I was able to obtain a fantastic deal for this home buyer as well and just yesterday, we went together to the Design Center to pick out his flooring, tile, carpet and window coverings.</p>
<p>Had either of these two home buyers not had representation I can assure you that they would not have gotten what these two home buyers will enjoy.</p>
<p>I have written several articles about home builders and buying a new home from a home builder which will help those home buyers considering buying a new home. The key is to have the Realtor take you to the new home subdivision first, not later.</p>
<p>A key point to buying any home whether it is a new home or a resell, it is essential that the home buyer has a home inspection. No home, condo or loft is perfect.  When buying a new home from a builder the home buyer can either have the home inspection before moving in or before the one year anniversary of when they purchased. That way, the builder will have to fix any items found that should have been addressed before move-in. Don’t leave it up to the home builder to inspect the property, hire your own representative. It may cost the home buyer $350 but the savings far out way the cost.</p>

<p>Congratulations on being a First Time Home Buyer. This is a fantastic opportunity for you to buy low in this real estate market.</p>
<p>In my opinion there is a big difference between just getting a loan at a bank and having a Mortgage Broker look for the best loan for you. A Mortgage Loan Broker is licensed and continues their education. They have been checked for felonies and keep up with all the best loans and new loan requirements. A Mortgage Broker seeks the best loan program for you from <strong>all</strong> the banks and other sources, not just one place.  No one works for free so yes there are costs associated with any loan whether its a bank or a Mortgage Broker. However, the Mortgage Broker is typically paid by the source where the loan will derive from. Appraisals are paid for by the home buyer and are required anytime a home buyer obtains a loan.  The bank wants to make sure that the money they loan you for a mortgage loan is a safe bet just in case you should default.</p>
<p>Whereas, the person at the bank is <strong>not</strong> necessarily licensed but works under the license of a Broker at the bank. The bank personnel only deal with what their bank promotes in terms of loan programs. As you can see, it may be a great deal but then again it may not. The bank also charges one way or another for the appraisal.</p>
<p>Usually, when you are working with a professional full time Realtor, they will be able to recommend a good Mortgage Broker for you that they have worked with in the past. No, Realtor do not get kick-backs from Mortgage Brokers. What they do get is a happy home buyer who has an excellent mortgage loan tailored to their specific needs and a smooth transaction that closes. This is what we call a win, win for everyone.</p>
<p>It is important to use someone local for your mortgage and the reason for that is that local Mortgage Brokers will make sure that all the costs associated with a house are included in the payment. I have seen where an outside Lender was used and when all was said and done, at the closing, suddenly the house payment went up considerably. This is something you want to avoid at all cost. Those types of surprises, no one needs.</p>

<p><strong>Home Buyer Tip</strong>:  Be sure to ask for a “Good Faith Estimate” from the bank and or the Mortgage Broker. This will show you a breakdown of all the costs associated with your home loan.  You are entitled to this by law, so be sure and ask for it. You are also entitled to a copy of the home appraisal, so make sure you ask for that, too.</p>
<p><strong>Homeowner Tip</strong>: Did you know that a smoke detector only has a life of 10 years? Yes, whether it is wired into your home or not. The fire department recommends that you replace your smoke detectors every 10 years. When purchasing a new home or condo make sure that you replace all the smoke detectors with new ones when you have your home or condo re-keyed.</p>

Today, we will spend the time to address this question for every home seller that is selling their house or will sell their house and clear the air.  <img border="0" align="right" src="http://sacramentorealestatevoice.com/wp-content/blogs.dir/142/files/2008/08/ask-20gena-20button.jpg" alt="Ask Real Estate Question" /></p>
<p>Whether selling your house in the Sacramento area or across the nation, there are simple rules to follow and common courtesy that should come in to play.</p>
<p>Let’s take a look at this <strong>Home Seller question</strong>:</p>
<p><strong>HOME SELLER:</strong></p>
<p>We have had our house on the market for about 2 weeks and have been very lucky as have had traffic just about every day. We have made every effort to show, sometimes in as little as 30 minutes notice.</p>
<p>However, we have a dog and work schedules so it can sometimes be hectic to accommodate, but we make it work as we know how important it is. However, my husband is out of town on a business trip for 2 days and we have both our home AND my cell phone listed to contact us.</p>
<p>I came home at 4:30pm with a message on my home machine from an agent at 2:49 pm saying she would like to show my home between 3-4pm and if she did not hear from me she would assume it was fine and leave a card. ??!! She attempted to arrive at 3:05 pm and hearing my dog bark, did not enter.</p>
<p>When I called back, I was pleasant but said I did not think it was reasonable to leave such a message and enter my home with 10-15 minutes notice. She was rude &amp; nasty and said this was perfectly appropriate and she did not need to reach me to show my home. I found this inappropriate as I have a large (but nice) dog as well as a laptop and other items out in my home as I had <strong>NO ONE</strong> call to schedule with me.</p>
<p>Out of curiosity, do you feel this is appropriate?</p>
<p><strong>ANSWER</strong>:</p>
<p>First let me say that common courtesy should always be how every real estate agent approaches showing a home. As a Realtor, we know that selling a house and having to keep the house in showable condition is not as easy as it may seem.</p>
<p>In California, there is a section of the MLS listing with “<em><strong>showing instructions”</strong></em> and another that is for “<strong><em>agents only</em></strong>.”  In the<em> showing instruction section</em>, the listing agent writes “call first, lockbox,” “call and make an appointment with seller.”  In the <em>agent remark section</em>, there should be information about the dog. Whether a dog is friendly or not, does not matter. This information needs to be documented for the selling agent and buyer protection as well as your own.</p>
<p>If the showing instructions indicated that an appointment needs to be made with the seller prior to showing, then you are absolutely right, the agent should not have tried to show. However, is there is no indication that an appointment needs to be made, then the agent was correct in attempting to show your home.</p>
<p>Most selling agents will call 24 hours ahead to let home sellers know that they wish to show a house. However, home buyers sometimes do not give the agent enough notice and want to see a home for sale right away. Personally, I don’t operate my real estate business like that.  I don’t show homes for sale on the fly.</p>
<p>The proper procedure in showing homes for sale is to first and foremost have the home buyers approved by a qualified, licensed Lender, schedule appointments with home sellers and then show homes. This not only protects the home buyer and let’s them know what they can afford and what type of loan they will be obtaining but it also protects the real estate professional and the home seller from those home buyers who think they can afford a house, only to find that they do not qualify.</p>
<p>You never know which home buyer will end up buying your house. I always tell my home sellers that yes they don’t have to show their property if it is inconvenient but it might just be the one home buyer that would have bought your house had they been able to see it.  The one time you deny access to your house, may just be the one time you would have received an offer on your home. This is a chance that only you, the home seller can make.</p>
<p>I have shown many houses and had many home sellers and always with those that have animals, I always request that either the animal be secured, a note placed that is easily read where the animal is located in the house and of course always make note of it in the “agent remarks” on the MLS listing.  No matter how friendly an animal is normally, this is their home and strangers are entering. This is a liability that should not be left to chance.</p>

<p>In conclusion, in a perfect world, yes the agent should give you proper notice of 24 hours prior to showing  but unfortunately it doesn’t work that way most of the time. If your house is for sale, you need to leave the house each morning knowing that someone may show the house. If that is not acceptable, then have your agent reword the MLS listing on the showing instructions to read, “make appointment with the seller.”  Appointments will give you a better sense of when an agent will show but also limits who will show your house.</p>
<p>There are 3 things that effect whether or not a home will sell:</p>
<ol>
<li><strong>Price</strong></li>
<li><strong>Accessibility</strong></li>
<li><strong>Appearance</strong></li>
</ol>
<p>Ask your Realtor for a copy of the MLS printout sheet that other Realtors see and check out what it says. I always provide my home sellers with a copy and have them sign it so that each of us knows exactly what the selling Realtor reads.</p>
<p>It is difficult living under a microscope when selling a house and I know that the stress level is high, I wish you good luck with the sale of your home and hope you receive an offer shortly.</p>
<p><strong>Here is a REAL example of one of my home sellers a few years ago</strong>:</p>
<p>I got a phone call early one Sunday morning from my Home Seller who told me that an agent from the Bay Area knocked on her door to show her house with no prior notice. She asked me if she had to show. I told her that &#8220;yes, it was rude on the part of the agent to show up announced and she didn&#8217;t have to show but that this might just be the Home Buyer that buys the house.&#8221;</p>
<p>The Home Seller decided to ask the Home Buyers to make themselves comfortable on her front porch while she prepared the family to leave the house.</p>
<p>These Home Buyers are now the proud homeowners of this house. Had the Home Seller refused to allow the home buyers entrance, they may not have bought the house and found another house where they could gain entrance.</p>
<p>You never know when you turn down a home buyer or make it difficult to show your house for sale who may have given you an offer you couldn&#8217;t refuse. It&#8217;s a chance you take.</p>

<p><em><strong>What is the time line for a Foreclosure?</strong></em></p>
<p>When a homeowner is late on paying their house payment this is the typical scenario of events.</p>
<ul>
<li>After 60 days of none payment the mortgage lender or service provider attempts to contact the homeowner to find out why their payment is late. The homeowner’s file is sent to the Collection Dept. and the service provider sends a “demand” or “breach” letter to the homeowner pointing out the terms of the mortgage that have been violated. The homeowner is given 30 days to bring the amount current by paying all penalties and late payments.</li>
</ul>
<ul>
<li>After 90 days a Notice of Default is recorded in the county where the property is located. This is considered “constructive notice” to the public. Any junior lien holders are given proper notice of default. The homeowner has 90 days to bring their past due account current. This period is also referred to as the <em>Reinstatement Period</em>.</li>
</ul>
<ul>
<li>Day 180–201 This is the time if the homeowner has not paid their past due amount current during the 90 day period that the lender will authorize the Trustee to record the Notice of Trustee Sale.  A foreclosure sale at public auction can take place 21 days after this recording.</li>
</ul>
<p><strong><em>I would like to buy a house but have no idea what my credit score means as opposed to a mortgage loan. Can you tell me what the numbers mean in plain English?</em></strong></p>
